TERMS & CONDITIONS

Contractual Relationship
Please read these terms and conditions (“terms and conditions”) as it is important for both of us that you understand our contractual relationship relating to your use of this website (the "site") Please note that in using this site, you agree to be bound by the following obligations:

• In making a booking (which includes an enquiry), you agree that these terms and conditions apply. "You" means the person who has completed the booking form and each and every member of the group on whose behalf that person has booked with us.
• You accept financial responsibility for all bookings in your name or account.
• You must make sure that all your information is true and accurate at all times.
• You must not use this site for an improper purpose, including but not limited to making speculative, false or fraudulent bookings.
• You must behave, at all times, in a safe and courteous manner and compensate us or our providers for any damage caused by you during the course of an activity or event ("event").
• The transmission of threatening, defamatory, pornographic, political or racist material or any material that is unlawful is expressly prohibited.
• The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you.


2. Agency

CorporateEscapade.com acts as agent for third party service providers (the “providers”). What this means is that the contract for the service is between you and the provider and unless expressly stated otherwise, we have no contractual liability to you in respect of that service as all rights and remedies are against the providers. This may mean that there are additional terms and conditions governing the contract as each provider will have terms and conditions relating to that service. Nothing in these terms and conditions is designed to give any other person any rights or remedies under the Contracts (Rights of Third Parties) Act 1999. All services sold through CorporateEscapade.com are not an offer by CorporateEscapade.com to sell any service, but an invitation to you to make an offer to our providers. We are free to accept that offer on behalf of the providers or to reject it. If your booking is accepted, we will send you an e-mail confirming the contract upon receipt of payment in accordance with the payment conditions in Clause 4 (Bookings).

3. Booking details
CorporateEscapade may pass your booking details to the relevant providers. The making of a booking by you will constitute consent to us passing on such personal information. You undertake to us that the details you give to us while using the site are correct and that there are sufficient funds to cover the cost of the booking. If there are any changes to the personal details supplied to us by you, it is your responsibility to notify CorporateEscapade by contacting us at latest, two (2) weeks before the event as detailed in Clause 4 (Variations) below. In the event of any changes to your details post event, notify CorporateEscapade and your details will be amended accordingly.


4. Bookings

Once you have made a booking on the site, we will contact the providers to pass on the details and to obtain confirmation that they are able to fulfil your booking. In the event that they are unable to fulfil your booking, we will notify you and suggest an alternative provider that can provide a similar service. At all times, we will endeavour to contact you within 48 hours of you making your booking.

- Payment
The total booking value is payable upon completion of your booking, no later than four (4) weeks before the event is scheduled to take place. Prices may be adjusted for currency fluctuations. We normally hold all monies pre-paid by you in a separate bank account until the event has taken place or the cancellation policy applies in accordance with the Package Travel Regulations 1992.

- Variations
Once a booking has been completed and processed, variations such as additions or deletions to your group, changes to the time and date, will only be permitted at the discretion of the provider and/or CorporateEscapade. Where variations are permitted, you must contact CorporateEscapade in writing of such a request as soon as possible and in any event at least four (4) weeks before the event as detailed in your booking confirmation.

- Last minute bookings
Last minute bookings will only be permitted at the discretion of the provider and/or CorporateEscapade with the proviso that only certain activities and tickets are available and hotel accommodation may be difficult to secure. Payment in full must be made promptly and received by CorporateEscapade at least one (1) week prior to day 1 of the event.

5. Payment conditions

Please note that bookings are made subject to availability, what this means is that we will pass your details onto our providers and we will subsequently contact you by email to confirm the booking. Please note that no contract is formed until we have contacted you and confirmed the booking upon receipt of payment. The e mail confirmation shall contain a description of the services included in the booking, including (without limitation) the date and time, the price and payment terms. Prices quoted are on a per group basis including VAT unless stated otherwise. Payment shall be by credit card or bank transfer to the account number specified in your confirmation.

6. Refund policy

CorporateEscapade does not provide refunds if an individual or group cancels an event If you wish to cancel your booking, please contact us in writing at www.corporateescapade.com as soon as possible and in any event at least four (4) weeks before the event as detailed in your booking confirmation. Depending on the date of cancellation, the following cancellation charges will apply before the event as detailed in your booking confirmation.

Partial Cancellations
In the event of cancellation of some members of the group only, then the cancellation charges outlined above apply pro rata but we may become entitled to cancel the event, and the group discounts may no longer apply. This may necessitate a further payment by you to pay the difference between the discounted price and the revised price.
  7. Force Majeure
”Force Majeure" includes war, riot, civil unrest, strike, industrial dispute, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, operational decisions of air carriers such as changes of schedule or any unforeseeable or unavoidable event beyond CorporateEscapade's control. In the event that your booking includes football tickets, as stated on the site, you should be aware that the time and date of the game is not confirmed until eight (8) days before the game and no tickets can be obtained for a Real Madrid or Atletico home game until five (5) days before the game. We will use our best efforts to buy the tickets as soon as they become available. However, in the unlikely event that tickets are unavailable or sold out, we reserve the right to refund you the money that you paid us for the football tickets as part of the package. Some of the activities are dependent on weather conditions to ensure the safety of all participants. Where any activity has to be cancelled due to adverse weather, the event will still take place notwithstanding this cancellation. We will do our best to ensure that you are advised in advance and upon request, we will try to reschedule the activity for another time or date if possible. We are not obliged to give any refund if an event is cancelled because of adverse weather conditions or a Force Majeure event.

8. Insurance
It is your responsibility to ensure that all members of your group are fully and adequately covered .

9. Health, safety and fitness
The activities may require a good level of fitness, strength and endurance. It is your responsibility to ensure that you are sufficiently fit and healthy to participate in the action. It is not recommended for those with any disability, illness or infirmity (although there are disabled facilities provided and everyone is welcome to watch the action). Bulls and horses, are by their nature, dangerous and unpredictable animals. If you choose to participate in these activities, you assume the risks involved and we exclude all liability for any damage or injury caused and will not be responsible unless it is the direct result of our negligent act or omission.

10 . No representation
The information, software, products, and services published on this site may include inaccuracies or typographical errors. Changes are periodically made to the site. CorporateEscapade makes no representations about the suitability of the information, software, products and services contained on this site for any purpose. CorporateEscapade shall use reasonable care and skill in carrying out the services contained in this site .

11. Notifications
For the avoidance of doubt, any notification to CorporateEscapade shall be made to info@corporateescapade.com


12. No responsibility
CorporateEscapade and its respective providers hereby disclaim any and all liability, all warranties, terms and conditions with regard to this information and the services, including all implied warranties, and conditions, of quality, fitness for a particular purpose, title, and non-infringement. CorporateEscapade is not responsible for inaccurate or misleading service descriptions. The information is given in good faith and is consistent with the information supplied by the provider to CorporateEscapade.

In no event shall CorporateEscapade and/or its providers be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or in any way connected with the use of this site or for failure to complete a booking, or for any information and services obtained through this site, whether based on contract, tort, strict liability or otherwise, even if CorporateEscapade or any of its providers have been advised of the possibility of damages. Except in relation to liability for death or personal injury for which no limit applies. CorporateEscapade and/or its respective providers shall only be liable for direct loss you suffer arising out of the use of this site (i) to the extent that we have caused you personal injury, provided that we will not be liable for any loss except to the extent required by law; and (ii) whether based on contract, tort, strict liability or otherwise, up to a maximum of the value of the booking under which the claim arises.
Our site may contain links to other third party websites over which CorporateEscapade has no control. CorporateEscapade assumes no responsibility in relation to the accuracy, completeness or quality of the information contained on those websites. Such links are provided for your reference only.


13. Copyright

The copyright and the propriety rights on the site and all content are owned by CorporateEscapade and in this respect CorporateEscapade reserves all rights. Images on this site are incorporated for viewing purposes only and may not be saved or downloaded in any format.

14. Updating of terms and conditions

CorporateEscapade reserves the right to vary or update these terms and conditions. CorporateEscapade will notify you of any changes promptly where they affect your booking. Please note that you will be unable to make a booking on-line unless you have confirmed that you have read and understood these terms and conditions.

15. Severability

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, without limitation, the warranty disclaimers and liability limitations set out above, then the invalid or unenforceable provision will be deemed to be replaced by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

16. Entire Agreement

This agreement constitutes the entire agreement between the customer and CorporateEscapade with respect to this site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and CorporateEscapade with respect to this site. Any rights not expressly granted herein are reserved.

17. Governing law

This agreement is between you and CorporateEscapade and is governed by the laws of England and Wales.

When you make a booking via the site, we have to collect information about you to process and fulfil your booking and provide you with the service that you expect. This information may include, but is not limited to, details such as your name, address, telephone number and email address. We may monitor hits and site usage to help us develop the design and layout of the site. However, we do not use technology to track the patterns of behaviour of visitors to our site such as the use of “cookies”.

Unless we have your express consent, we will only disclose personal data to third parties if this is required for the purpose of completing your booking. This is subject to the proviso that we may disclose your data to certain permitted third parties, such as members of our own group, our own professional advisers who are bound by confidentiality, and when we are legally obliged to disclose your data
